• This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. 

• This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name [https://3awellness.com/] (“Website”), including the related mobile site and mobile application (hereinafter referred to as “Platform”). 

• The Platform is owned by (3AWellness Inc.), a company incorporated under the Companies Act, 1956 with its registered office at (3A WELLNESS INC.

• Your use of the Platform and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with the Platform Owner and these terms and conditions including the policies constitute Your binding obligations, with Platform Owner. These Terms of Use relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, “Services”). Any terms and conditions proposed by You which are in addition to or which conflict with these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. These Terms of Use can be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms of Use to stay informed of updates. 

• For the purpose of these Terms of Use, wherever the context so requires “you”, “your” or “user” shall mean any natural or legal person who has agreed to become a user/buyer on the Platform. 

• ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.  

• The use of Platform and/or availing of our Services is subject to the following Terms of Use: 

• To access and use the Services, you agree to provide true, accurate and complete information to us during and after registration, and you shall be responsible for all acts done through the use of your registered account on the Platform. 

• Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this website or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. 

• Your use of our Services and the Platform is solely and entirely at your own risk and discretion for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements. 

• The contents of the Platform and the Services are proprietary to us and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. The contents includes and is not limited to the design, layout, look and graphics. 

• You acknowledge that unauthorized use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws. 

• You agree to pay us the charges associated with availing the Services. 

• You agree not to use the Platform and/ or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or Indian or local laws that might apply to you. 

• You agree and acknowledge that website and the Services may contain links to other third party websites. On accessing these links, you will be governed by the terms of use, privacy policy and such other policies of such third party websites. These links are provided for your convenience for provide further information. 

• You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with the Platform Owner for the Services. 

• You shall indemnify and hold harmless Platform Owner, its affiliates, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party. 

• In no event will the Platform Owner be liable for any indirect, consequential, incidental, special or punitive damages, including without limitation damages for loss of profits or revenues, business interruption, loss of business opportunities, loss of data or loss of other economic interests, whether in contract, negligence, tort or otherwise, arising from the use of or inability to use the Services, however caused and whether arising in contract, tort, negligence, warranty or otherwise, exceed the amount paid by You for using the Services giving rise to the cause of action or Rupees One Hundred (Rs. 100) whichever is less 

• Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event. 

• These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India. 

• All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in (Meerut, Uttar Pradesh – 250001, India)

2. USING OUR WEBSITE 

You agree to use our website only for lawful purposes and in accordance with these Terms. 

You must not: 

• Use the website for fraudulent or unlawful activities. 

• Attempt to gain unauthorised access to our systems. 

• Introduce viruses, malware or other harmful code. 

• Interfere with the operation or security of the website. 

• Copy, reproduce or commercially exploit our website content without permission. 

• Use automated systems to scrape or collect website information without our written permission. 

• Place orders using false, misleading or unauthorised information.

We reserve the right to restrict or suspend access to the website where we reasonably believe that these Terms have been violated or that the website is being misused. 

3. PRODUCT INFORMATION 

We make reasonable efforts to ensure that product descriptions, images, specifications, prices and other information displayed on our website are accurate and up to date. 

However, you should understand that: 

• Product colours may appear slightly different depending on your screen or device. 

• Images may sometimes be for illustrative purposes where specifically mentioned. 

• Packaging, labels or minor product details may change from time to time. 

• Product availability can change without prior notice.

4. PRODUCT AVAILABILITY 

All products displayed on our website are subject to availability. 

Adding a product to your cart does not guarantee that the product will remain available until checkout is completed. 

If an ordered product becomes unavailable due to an inventory or operational issue, we may: 

• Inform you about the issue; 

• Cancel the affected order or item; 

• Offer an alternative where appropriate; or 

• Process an applicable refund. 

If we cancel an order after payment has been successfully received, the applicable amount paid for the cancelled item/order will be refunded through the appropriate payment method or process. 

5. PRICES 

All prices displayed on the website are in Indian Rupees (INR) unless otherwise stated. 

Prices may include applicable taxes as displayed at checkout. 

We reserve the right to change product prices, discounts and promotional offers at any time. 

However, once an order has been successfully accepted and confirmed, the price applicable to that order will generally be the price communicated to you at the time of order confirmation, subject to circumstances such as an obvious pricing error, fraud or other circumstances permitted by law. 

6. PRICING OR LISTING ERRORS 

We take reasonable care to ensure that prices and product information are accurate. 

Occasionally, an obvious typographical, technical or system error may result in an incorrect price or product information being displayed. 

If an order has been placed at an obviously incorrect price due to such an error, we reserve the right to cancel the order after informing you. 

If payment has already been made, the amount paid for the cancelled order will be refunded. 

7. OFFERS, DISCOUNTS AND PROMOTIONAL CODES 

From time to time, we may offer promotional discounts, coupon codes, cashback or other offers. 

Unless specifically stated otherwise: 

• Promotional codes cannot be exchanged for cash. 

• Only one promotional code may be used per order where the offer specifies this limitation. 

• Offers may have product, customer, order-value or validity restrictions. 

• Promotional offers cannot be combined unless expressly permitted. 

• Offers may be withdrawn or modified in accordance with their stated terms. 

• A promotional code may be cancelled if it is obtained or used fraudulently or contrary to its terms. 

Specific terms displayed with an offer will apply in addition to these Terms. 

8. PLACING AN ORDER 

You can place an order by selecting the desired products and completing the checkout process on our website. 

Before submitting an order, please carefully check:

• Variant, size, colour or other applicable selection 

• Delivery address

• Price 

• Applicable discounts 

• Shipping charges, if any 

• Payment method 

Once an order is placed, you may receive an order acknowledgement or confirmation by email, SMS, WhatsApp or another available communication channel. 

An order acknowledgement confirms that we have received your order. It does not necessarily mean that the order has been finally accepted in every circumstance. 

9. ORDER ACCEPTANCE AND CANCELLATION BY US 

We reserve the right to refuse, cancel or limit an order in reasonable circumstances, including: 

• Product unavailability 

• Pricing or listing errors 

• Suspected fraud 

• Incorrect or incomplete customer information 

• Unusual or suspicious ordering activity 

• Delivery restrictions 

• Technical or system errors 

• Multiple orders appearing to be placed for unauthorised resale where restrictions apply 

• Violation of these Terms 

• Circumstances beyond our reasonable control 

Where an order is cancelled after payment has been received, the applicable amount paid for the cancelled order will be refunded. 

10. CUSTOMER ACCOUNT 

If our website allows you to create an account, you are responsible for keeping your login information confidential. 

You should: 

• Use accurate information. 

• Keep your password secure. 

• Not share your account credentials with others. 

• Notify us if you believe your account has been compromised. 

You are responsible for activities carried out through your account unless you notify us of unauthorised access and applicable law provides otherwise. 

We may suspend or terminate accounts that are used fraudulently, unlawfully or in violation of these Terms. 

11. PAYMENT 

We may offer multiple payment methods through third-party payment and checkout service providers. 

These may include methods such as: 

• Credit cards 

• Debit cards 

• UPI 

• Net banking 

• Wallets 

• Other payment methods made available at checkout 

• Cash on Delivery, where available 

Payment processing may be handled by third-party payment providers. 

You agree to provide accurate payment and billing information and confirm that you are authorised to use the selected payment method. 

We do not ask customers to share OTPs, UPI PINs, CVVs, passwords or other payment authentication credentials with our employees or representatives. 

12. CASH ON DELIVERY 

Where Cash on Delivery is available, the option may be subject to: 

• Product eligibility 

• Order value limits 

• Delivery location 

• Customer history 

• Serviceability 

• Operational restrictions 

We may restrict or discontinue COD for certain locations, products or orders. 

The applicable COD terms, charges and availability will be displayed during checkout where applicable. 

13. SHIPPING AND DELIVERY 

We work with third-party logistics and delivery partners to deliver orders. 

Delivery timelines shown on the website are estimates and may vary due to: 

• Delivery location 

• Courier capacity 

• Weather 

• Public holidays 

• Transportation disruptions 

• Address-related issues 

• Regulatory restrictions 

• Operational circumstances 

• Events beyond our reasonable control 

We will make reasonable efforts to dispatch and deliver orders within the communicated timeline. 

However, a delivery estimate is not an unconditional guarantee of delivery on a particular date unless expressly stated otherwise. 

14. CUSTOMER RESPONSIBILITY FOR DELIVERY INFORMATION 

Customers are responsible for providing accurate delivery information. 

Please check your: 

• Name 

• Mobile number 

• Email address 

• House/building number 

• Street/locality 

• City 

• State 

• PIN code 

• Other delivery instructions 

If an order cannot be delivered because incorrect or incomplete information was provided, additional delivery attempts, charges or cancellation may apply depending on the circumstances. 

15. DELIVERY ATTEMPTS AND UNDELIVERED ORDERS 

Our logistics partners may make one or more delivery attempts depending on their operational process. 

An order may be returned to us if: 

• The customer is unavailable; 

• The address is incorrect or incomplete; 

• The customer refuses delivery; 

• The customer does not respond to delivery attempts; 

• The delivery location is not serviceable; 

• The shipment cannot otherwise be delivered. 

Any refund, cancellation or re-shipment resulting from an undelivered order will be handled in accordance with our applicable Shipping, Refund & Cancellation Policy. 

16. CANCELLATION BY THE CUSTOMER 

Where cancellation is available, you may request cancellation before the order reaches the stage where cancellation is no longer operationally possible. 

Once an order has been packed, dispatched or handed over to a logistics partner, cancellation may not always be possible. 

Where cancellation is not possible, you may need to follow the applicable return/refusal/refund process. 

The specific cancellation process and applicable timelines will be communicated through our website or customer-support channels. 

17. EXCHANGES AND REFUNDS 

Exchanges and refunds are governed by our separate: 

Shipping, Refund & Cancellation Policy 

That policy forms part of these Terms & Conditions. 

Before placing an order, customers are encouraged to review the applicable policy for the relevant product. 

Any statutory consumer rights available under applicable law will not be excluded by our policies. 

Exchanging / Replacement policy: All Exchanging / Replacement products will be delivered within 7 business days.

18. REFUND PROCESSING 

Where a refund is approved, the refund will generally be processed through the original payment method or another appropriate method depending on the circumstances and payment provider. 

The time taken for the amount to appear in your account may depend on: 

• Payment method 

• Bank 

• Payment gateway 

• Card issuer 

• Financial institution 

• Refund processing timelines 

We are not responsible for delays caused solely by banks or third-party payment providers after we have initiated the refund. 

19. DAMAGED, WRONG OR DEFECTIVE PRODUCTS 

If you receive a product that is: 

• Damaged; 

• Defective; 

• Incorrect; or 

• Different from the product ordered, 

please contact us promptly at support@3awellness.com with your order details and relevant photographs/videos or other information requested by our support team. 

We may investigate the issue and request reasonable evidence to determine the appropriate resolution. 

Depending on the circumstances and applicable policy, the resolution may include: 

• Replacement 

• Exchange 

• Refund 

• Other appropriate remedy 

Nothing in these Terms limits any consumer rights available under applicable law. 

20. PRODUCT USE AND WELLNESS DISCLAIMER 

3A Wellness may sell wellness, nutrition, health-related or lifestyle products. 

Unless a product page expressly states otherwise, information provided on our website about a product is intended for general informational purposes and should not automatically be treated as medical advice, diagnosis or treatment. 

You should carefully read product labels, instructions, warnings and usage information before using a product. 

If you have a medical condition, are pregnant or breastfeeding, take medication, have allergies, or have any other concern regarding the use of a wellness product, you should consult an appropriately qualified healthcare professional before using the product where appropriate. 

Do not use a product contrary to its label, instructions or warnings. 

If you experience an unexpected reaction or other serious concern after using a product, discontinue use where appropriate and seek professional medical assistance.

Nothing in these Terms limits statutory consumer rights or remedies available to you under applicable law. 

29. FORCE MAJEURE 

We will not be responsible for delays or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control. 

These circumstances may include:

• Floods 

• Earthquakes 

• Fire 

• Epidemics or pandemics 

• War 

• Civil unrest 

• Government restrictions 

• Strikes 

• Transportation disruptions 

• Major technology or network failures 

• Cybersecurity incidents

We will make reasonable efforts to resume normal operations as soon as reasonably possible. 

30. INDEMNITY

Subject to applicable consumer-protection laws and jurisdictional rules, disputes relating to these Terms or transactions with 3A Wellness will be subject to the jurisdiction of the competent courts and authorities in India. 

33. CONSUMER RIGHTS 

Nothing in these Terms is intended to take away any right or remedy that you are legally entitled to under applicable consumer-protection laws. 

Where a provision of these Terms conflicts with a mandatory requirement of applicable law, the mandatory legal requirement will prevail to the extent of that conflict. 

The Consumer Protection (E-Commerce) Rules, 2020 apply to e-commerce retail and address consumer protection and unfair trade practices in e-commerce transactions. 

34. GRIEVANCE REDRESSAL 

If you have a complaint, concern or issue relating to an order, product, payment, delivery or use of our website, please contact us first.

Where a product-specific policy or offer contains additional terms, those terms will apply to the relevant product, order or offer.
